- Prices
Except as otherwise expressly stated posh paint reserves the right to vary prices at any time. The price per item does not include the cost of freight carriage and will be additionally charged to the buyer. Prices quoted on the www.poshpaint.com website are available for UK customers only. Prices include VAT @20% - Delivery
2.1 posh paint shall make all reasonable efforts to meet ‘a delivery date’. Time shall not be of essence and so long as any circumstances whatsoever may prevent hinder or delay any delivery.2.2 posh paint shall not be bound to keep the same and shall not be liable in any manner whatsoever for failure or delay whilst so prevented hindered or delayed.2.3 posh paint reserves the right to deliver by instalments. The buyer shall inspect all Goods on delivery and unless the buyer takes the following actions the buyer will be deemed to have accepted the delivery in full contractual satisfaction of the order:
2.4 Buyer shall inspect goods upon delivery and endorse Carrier’s note appropriately. Where goods are received by the customer or agent and are found to be damaged or missing please inform us upon receipt. No claims will be considered after 24hrs of receipt
2.5 Buyer shall advise posh paint immediately by telephone of any damage and confirm such call in writing by e mail
2.6 Buyer shall send full particulars of claim including photographs to posh paint in writing within 3 days after delivery.
2.7 In case of non-delivery of a consignment, the Buyer shall advise posh paint within 10 days after date of the order.
2.8 Damaged or missing goods will be replaced free of charge, assuming the above criteria have been met, as soon as possible, or a refund for damaged items will be processed
2.9 The Buyer shall be bound to pay for all goods, notwithstanding any alleged non-delivery or shortage of goods, if the foregoing conditions have not been complied with.
Where the Buyer orders standard or non-standard products which are specifically tinted, manufactured or produced to his unique requirements, the Buyer shall accept the supply of goods which are non returnable.
- Title & Risk
THE RISK in the Goods shall pass to the Customer as from the time when the Goods are either:a) Where the Customer or his nominee or representative (which the latter term shall include a carrier nominated by the Customer) collects the Goods from the shopb) Delivery to the Customer’s premises.
- TITLE AND PROPERTY in the Goods shall not pass to the Customer until whichever of the following events first occurs and until such time the goods shall remain the sole and absolute property of posh paint.
4.1 The customer shall have paid posh paint the full amount of the agreed price
- Liability for Accidents & Damage
posh paint shall not be liable to the Buyer for loss injury damage or claim consequential or direct or natural of any kind whatsoever arising out of or in connection with the use of goods supplied by posh paint. - Payment
All payments shall be completed in advance of dispatch of goodsPlease note paints that have been especially tinted for you cannot be returned. We advise the purchase of a tester pot if you are unsure about a colour. Colours seen on the monitor can vary in depth and colour tone.
There may be slight colour variations between batches and tints. We strongly advise that you purchase all the paint you need in one batch. This can reduce any batch variation. All paint is checked for colour accuracy and quality prior to dispatch.
- Order processing
We will endeavour to send you order as soon as possible. Please allow 3 – 4 working days for delivery. You will be contacted by e mail at the earliest opportunity and given an estimated delivery date if we are out of stock.
Please order in plenty of time if you have a deadline for decorators to allow for unexpected delays.
Some orders/goods may be dispatched direct from the manufacturer.
Delivery times are calculated in working days, which are Monday to Friday excluding Saturday, Sunday and Bank Holidays.
Posh paint does not accept any responsibility or claims whatsoever for liability or loss due to the late delivery of goods. Any quoted delivery times are estimates only.
There may be occasions out of our control that effect delivery times, these include; products being damaged/lost in transit, weather conditions, supplier errors etc. You will be contacted in the unlikely event your order has been delayed.
Delivery charges apply to UK mainland, Deliveries to more remote locations may take longer and we reserve the right to charge more for carriage. Please ask for a quotation before placing your order as surcharges may apply.
Express delivery am or next day is available. Please contact us on 01837 55565 to ask for a quotation and arrange payment.
- Cancellation of Goods
You have the right to cancel your order up to the point of dispatch from ourselves or our suppliers. However, if there is tinted paint in your order that has already been tinted you will only be refunded for the non- tinted items. Orders for Products may be cancelled with full refund if we fail to deliver for reasons beyond our control, providing the product has not left our premises, or been tinted to the buyer’s specification. Please be aware that during the day we process most orders within 4 hrs. - Refunds
Please allow 3 working days for refunds to be processed. This does not affect your statutory rights.
- Return of Goods
No Goods are supplied on a sale or return basis. There should be no liability on posh paint to accept returned Goods. Any Goods returned by a Buyer or anybody acting on his behalf will remain the risk of the Buyer and posh paint for the avoidance of doubt confirms that no liability of any description is accepted in respect of returned Goods. - Mixed tinted paint
Paints that have been mixed include Little Greene, Paint and Paper Library, Sanderson, Zoffany, Designer Guild ,Farrow and Ball Archive colours.
Please contract us before placing your order if you are unsure about the colour or product suitability. We cannot accept returns. - Advise given by posh paint
12.1 We are happy to offer our professional advice and answer any questions you have about products on this site, or decorating projects you have, However, any advice given whether verbal or in writing given is for guidance only and is given in good faith to the best of our abilities.
12.2 It is the responsibility of the customer to order the correct product and product quantities, this is especially important as tinted product cannot be returned.
